What is the FIFA Agents Regulation?

The 2023 FIFA Agents Regulation offers a chance to redefine the role and activities of agents, aiming to modernize the overall framework and ensure smoother operations in transfers.

Introduction
The new regulations introduce basic service and regulatory standards for football agents and their clients, including a mandatory licensing system, the prohibition of multiple representation to avoid conflicts of interest, and the introduction of a cap on agent fees, all with the objective of reinforcing contractual stability, protecting the integrity of the transfer system and achieving greater financial transparency.
Objective
Its objective is to regulate football agent activities and ensure transparency within the transfer system. It sets the procedures for licensing of football agents’, Continuing Professional Development (CPD) requirements and procedures for resolving disputes.
What the regulation entails
Under the Regulations, prospective agents will need to achieve 75% (being 15 out of 20 multiple choice questions in an hour) to pass. Existing agents who do not comply with the   requirements of their CPD or pay the annual licensing fee of $300, will have their licence suspended and will not be permitted to carry out football agent services, which could lead to their representation contracts being terminated and they may lose their right to be paid commission in respect of previous deals.

Under the new Regulations, any clause in a representation agreement which:  restricts the ability of an individual for not using an agent (such as clauses which restrict players from representing themselves); or penalises an individual for doing so, are deemed null and void.

The Agents Department manages the procedures relating to disputes involving Football Agents decided by the Agents Chamber of the Football Tribunal and the licence applications to become and remain a FIFA-licensed Football Agent.
